1. ACCEPTANCE OF TERMS
Welcome to LiveScan Occupational Health & Compliance Services ("LiveScan Health," "we," "us," or "our").
These Terms & Conditions ("Terms") govern your access to and use of www.livescanhealth.com, including the use of our online appointment scheduling system, forms, communications, payment features, and services offered through or in connection with our website.
By accessing our website, scheduling an appointment, submitting information, purchasing services, or otherwise using our website or services, you acknowledge that you have read, understood, and agree to these Terms.
If you are scheduling or purchasing services on behalf of another individual or an organization, you represent that you have the authority to do so.
If you do not agree with these Terms, please do not use the website or its online services.
2. OUR SERVICES
LiveScan Occupational Health & Compliance Services provides occupational-health, employment-screening, testing, and compliance-related services, which may include:
• DOT physical examinations;
• Non-DOT and employment physical examinations;
• Pre-employment physical examinations;
• Fitness-for-duty examinations;
• School bus driver physical examinations;
• Security guard physical examinations;
• Other occupational-health, compliance, and employment-screening services offered by LiveScan Health.
The availability, requirements, pricing, turnaround time, and eligibility criteria for services may vary.
We reserve the right to add, modify, suspend, or discontinue services at any time, subject to applicable law and existing contractual obligations.
3. ONLINE APPOINTMENTS
Appointments may be scheduled through our website, by telephone, by email, or through another scheduling method authorized by LiveScan Health.
When scheduling an appointment, you agree to provide accurate and complete information.
Appointment availability displayed online is subject to change. An appointment is not guaranteed until the scheduling process has been completed and any required payment or confirmation has been received.
Certain services may require additional documentation before an appointment can be completed.
4. ARRIVING FOR YOUR APPOINTMENT
Clients should arrive on time and bring all identification, authorization forms, employer documentation, prescriptions, medical information, or other documents required for the service being performed.
Depending upon the service, you may be required to present a valid, unexpired government-issued photo identification.
Failure to provide required identification or documentation may prevent us from completing your service and may require the appointment to be rescheduled.
Clients should follow any preparation instructions provided before their appointment.
5. LATE ARRIVALS
Clients who arrive late may experience a shortened appointment, an extended wait, or may be required to reschedule.
We make reasonable efforts to accommodate late arrivals; however, accommodation cannot be guaranteed because doing so may interfere with appointments scheduled for other clients.
6. CANCELLATIONS AND RESCHEDULING
We understand that schedules change.
Clients should contact LiveScan Health within 24 hours of your appointment to reschedule it, the cost for a reschedule appointment is $25.00.
Certain appointments, employer-sponsored services, mobile services, group services, specialized examinations, laboratory services, or other reserved services may be subject to specific cancellation or rescheduling requirements disclosed at the time of scheduling or in a separate agreement.
Repeated missed appointments or last-minute cancellations are non-refundable. You will need to pay for a new appointment.
Where a separate written contract, employer agreement, proposal, quote, or service agreement establishes a specific cancellation policy, the terms of that agreement will control.
7. NO-SHOW POLICY
A client is considered a "no-show" when the client fails to appear for a scheduled appointment without providing appropriate notice.
Fees paid for services involving laboratory supplies, third-party processing, special ordering, reserved clinical time, or other non recoverable costs are nonrefundable.
LiveScan Health reserves the right to require advance payment before rescheduling an appointment following a no-show.
8. PAYMENT
Payment is generally due at the time services are rendered unless LiveScan Health has entered into a separate written billing arrangement with an employer, organization, government agency, or other client.
We may accept payment through the payment methods displayed on our website or otherwise authorized by LiveScan Health.
Organizations with approved invoicing or contractual arrangements will be subject to the payment terms stated in their applicable agreement or invoice.
Clients are responsible for verifying whether their employer or organization is paying for a service before the service is performed.
If an employer or organization does not have an established payment arrangement with LiveScan Health, the individual receiving the service will be responsible for payment.
9. PRICING
Prices displayed on the website are subject to change.
The price applicable at the time an appointment is booked will generally apply unless:
• the client selects an incorrect service;
• additional services are requested or required;
• an employer or organization has separately negotiated pricing;
• laboratory or third-party charges apply; or
• a pricing error appears on the website.
We reserve the right to correct typographical or pricing errors.
10. REFUNDS
Because many of our services involve professional time, laboratory processing, third-party fees, medical examinations, testing materials, or reports that cannot be returned once initiated, completed services are NOT nonrefundable.
No refund will be provided merely because a test result, medical determination, background-screening result, or other outcome is different from the result desired or expected by the client.
Nothing in this section limits any refund rights required by applicable law.
OCCUPATIONAL & MEDICAL SERVICES
11. DOT PHYSICAL EXAMINATIONS
DOT physical examinations are conducted in accordance with applicable Federal Motor Carrier Safety Administration ("FMCSA") requirements.
A DOT physical does not guarantee that an individual will receive a Medical Examiner's Certificate.
The medical examiner must make an independent professional determination regarding whether the individual satisfies applicable medical qualification standards.
Depending upon the individual's medical history, examination findings, medications, or other circumstances, the medical examiner may require additional documentation or evaluation before making a certification determination.
Certification periods may vary based upon applicable regulations and the medical examiner's professional determination.
12. NON-DOT AND EMPLOYMENT PHYSICALS
Employment and occupational physical examinations are performed based upon the examination requested and any applicable employer, regulatory, contractual, or occupational requirements.
The individual is responsible for providing accurate information regarding medical history, medications, symptoms, and other information reasonably requested by the examining provider.
LiveScan Health does not guarantee that an individual will be medically cleared, found fit for duty, or otherwise satisfy an employer's requirements.
Clinical determinations are made by the examining healthcare professional based upon applicable standards and the information available at the time of the examination.
13. MEDICAL INFORMATION AND DOCUMENTATION
Certain examinations may require additional medical documentation.
Examples may include information regarding:
• medications;
• medical conditions;
• surgeries;
• vision;
• hearing;
• cardiovascular conditions;
• diabetes;
• sleep disorders;
• neurological conditions; or
• other conditions relevant to the requested examination.
Failure to provide requested documentation may delay completion of the examination or certification.
LiveScan Health does not guarantee same-day certification when additional medical information is necessary.
14. NO GUARANTEE OF MEDICAL CERTIFICATION OR CLEARANCE
Payment for an examination is payment for the professional service and evaluation being performed.
Payment does not guarantee a passing result, medical clearance, DOT certification, employment qualification, fitness-for-duty determination, or any particular outcome.
Fees remain due for examinations properly performed even when the individual does not receive the certification or clearance sought.
15. EMPLOYER-ORDERED TESTING
When testing is ordered and paid for by an employer or other authorized organization, results may be transmitted to the employer's authorized representative, MRO, laboratory, consortium/third-party administrator, or other authorized recipient as permitted by applicable law and the applicable testing program.
Individuals should direct questions concerning an employer's hiring or employment decisions to the employer.
LiveScan Health does not make employment decisions for an employer merely by collecting or facilitating a drug test.
16. EMPLOYMENT DECISIONS AND ADVERSE ACTION
LiveScan Health does not make hiring, promotion, retention, termination, or other employment decisions on behalf of an employer unless expressly authorized under a separate lawful arrangement.
The employer or organization receiving a report is responsible for making its own employment decisions.
When applicable, employers are responsible for complying with FCRA pre-adverse and adverse-action requirements and any additional federal, state, or local requirements.
17. ACCURACY AND DISPUTES
LiveScan Health will process applicable disputes in accordance with legal requirements governing the service involved.
PRIVACY & INFORMATION
18. PERSONAL INFORMATION
Our collection, use, storage, and disclosure of personal information through the website is governed by our Website Privacy Policy, which is incorporated into these Terms by reference.
By using the website, you acknowledge that you have had an opportunity to review our Website Privacy Policy.
19. HEALTH INFORMATION AND HIPAA
Certain information collected in connection with healthcare services may constitute protected health information ("PHI") under applicable law.
Where LiveScan Health is subject to HIPAA as a covered entity or business associate, applicable health information will be handled in accordance with HIPAA and other applicable privacy and security requirements.
Our Website Privacy Policy and these Terms do not replace any Notice of Privacy Practices, HIPAA authorization, medical consent, testing consent, or other documentation required by applicable law.
20. COMMUNICATIONS
By providing a telephone number or email address, you authorize LiveScan Health to use that information for legitimate communications concerning your appointment, services, account, documentation, payment, or other business-related matters, subject to applicable law.
Appointment reminders and administrative communications should not be considered emergency communications.
You are responsible for ensuring that your contact information remains accurate.
21. THIRD-PARTY SERVICE PROVIDERS
LiveScan Health may utilize third-party service providers in connection with its operations, including:
• laboratories;
• Medical Review Officers;
• scheduling platforms;
• payment processors;
• secure communications providers;
• cloud service providers; and
• other professional or compliance vendors.
These third parties may operate under their own terms, privacy policies, legal requirements, contracts, or business associate agreements, as applicable.
LiveScan Health is not responsible for the independent acts of third parties outside our reasonable control except where liability is imposed by applicable law.
WEBSITE USE
22. ACCEPTABLE USE
You agree not to:
• use the website for unlawful or fraudulent purposes;
• provide false or misleading information;
• impersonate another person;
• attempt unauthorized access to our systems;
• interfere with website security or operation;
• introduce malicious software;

Nothing in these Terms is intended to waive, exclude, or limit liability that cannot legally be waived or limited, including obligations imposed by applicable healthcare, privacy, consumer-protection, or other laws.
28. CLIENT RESPONSIBILITY
Clients are responsible for providing truthful, accurate, and complete information.
LiveScan Health is not responsible for delays, inability to complete services, or inaccurate outcomes resulting from materially incorrect or incomplete information supplied by a client, employer, organization, or third party, except to the extent otherwise required by law.
29. EMPLOYER AND ORGANIZATIONAL CLIENTS
Employers and organizations purchasing services from LiveScan Health are responsible for ensuring that their requests comply with applicable employment, privacy, discrimination, consumer-reporting, drug-testing, occupational-health, and other applicable laws.
A client's use of LiveScan Health does not transfer the client's legal or regulatory obligations to LiveScan Health.
Separate corporate agreements, proposals, purchase orders, or service contracts may contain additional terms.
If a signed written agreement between LiveScan Health and an organizational client conflicts with these website Terms regarding the contracted services, the signed agreement will control the extent of the conflict.
30. GOVERNING LAW
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
Any dispute concerning these Terms will be handled in accordance with applicable law and any separately executed agreement between the parties.
31. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
32. NO WAIVER
Failure by LiveScan Health to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
33. CHANGES TO THESE TERMS
We may revise these Terms periodically to reflect changes in our services, business practices, technology, or applicable legal requirements.
When material changes are made, the revised Terms will be posted on our website with an updated "Last Updated" date.
Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
