NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

LiveScan Health is committed to protecting the privacy and confidentiality of your health information. This Notice of Privacy Practices explains how we may use and disclose your protected health information (“PHI”), your rights regarding your health information, and our responsibilities for protecting that information.

 

OUR RESPONSIBILITIES

LiveScan Health is committed to maintaining the privacy and security of your protected health information.

We will:

  • Protect the privacy and security of your health information as required by applicable law.

  • Provide you with this Notice describing our privacy practices and legal responsibilities.

  • Follow the privacy practices described in the Notice currently in effect.

  • Notify you as required by law if a breach occurs that may have compromised the privacy or security of your protected health information.

  • Limit our use and disclosure of your health information to what is permitted or required by law.

  • Obtain your written authorization before using or disclosing your health information when authorization is required.

 

HOW WE MAY USE AND DISCLOSE YOUR HEALTH INFORMATION

 

Treatment

We may use or disclose your health information to provide, coordinate, or manage healthcare services and related services.

For example, information obtained during an examination may be used by the healthcare professional providing your services or may be shared with another healthcare provider when necessary for your care.

 

Payment

We may use or disclose health information as necessary to obtain payment for healthcare services provided to you, when applicable.

 

Healthcare Operations

We may use health information for legitimate healthcare operations, including quality assessment, staff training, compliance activities, auditing, business administration, and improving our services.

Occupational and Employment-Related Services

LiveScan Health provides occupational health and employment-related services, which may include:

  • DOT physical examinations

  • Employment physical examinations

  • Fitness-for-duty examinations

  • School bus driver examinations

  • Drug and alcohol testing

  • Other occupational health and compliance services

 

When an employer, government agency, or other organization requests or pays for an occupational health service, certain examination results or documentation may be provided to the requesting organization when authorized or permitted by applicable law.

We will limit information disclosed to employers and other third parties as required by applicable federal and state laws and regulations.

 

Required by Law

We may disclose health information when required or permitted by federal, state, or local law. This may include disclosures involving public health activities, government oversight, workers' compensation, law enforcement, judicial proceedings, or other legally authorized purposes.

 

YOUR RIGHTS

Depending upon applicable law, you have certain rights regarding your protected health information.

These rights may include the right to:

  • Request access to and obtain a copy of certain health information maintained about you.

  • Request corrections or amendments to your health information.

  • Request restrictions on certain uses or disclosures of your health information.

  • Request that we communicate with you in a specific way or at a specific location.

  • Request an accounting of certain disclosures of your health information.

  • Receive a paper copy of this Notice of Privacy Practices.

  • File a complaint if you believe your privacy rights have been violated.

We will not retaliate against you for exercising your privacy rights or filing a privacy complaint.

 

YOUR CHOICES

For certain uses and disclosures of your health information, we may ask for your written authorization.

When written authorization is required, you may revoke that authorization in writing, subject to limitations when we have already acted in reliance upon your authorization.

We will not use or disclose your protected health information for purposes not permitted by law or described in this Notice without obtaining your authorization when authorization is required.

 

 

ELECTRONIC INFORMATION AND COMMUNICATIONS

LiveScan Health may maintain health information electronically and may communicate with patients through electronic systems.

We use reasonable administrative, physical, and technical safeguards designed to protect health information from unauthorized access, use, disclosure, alteration, or destruction.

Patients should understand that ordinary email or other electronic communications may present privacy and security risks. Please avoid sending sensitive medical information through unsecured communication methods unless instructed to do so.

 

BUSINESS ASSOCIATES

LiveScan Health may use third-party vendors and service providers to perform certain services on our behalf.

When a third party is considered a Business Associate under HIPAA and has access to protected health information, we require appropriate contractual safeguards, including a Business Associate Agreement when required by law.

 

CHANGES TO THIS NOTICE

LiveScan Health reserves the right to change this Notice and our privacy practices as permitted by law.

Any revised Notice may apply to health information we already maintain as well as information we receive in the future.

The current Notice will be available at our office and on our website.

LiveScan Health will not retaliate against you for filing a complaint or exercising your privacy rights.
